Texas Burn Ban Legislation

SUBCHAPTER D. OUTDOOR BURNING
§ 352.081. REGULATION OF OUTDOOR BURNING.

Prescribed - Controlled Burn
General Requirements:
  1. CHECK that a Burn Ban is not currently active.
  2. Create directions to the burn location and plan emergency access to the burn site.
  3. BEFORE BURNING, notify the Fredericksburg Fire Department at 830-997-5603 of your plans to burn.
  4. Burn only outside the corporate limits of a city or town.
  5. Burn only when the wind or other weather conditions are such that smoke will not present a hazard, nuisance to others or affect road / highway visibility.
  6. Begin burning no earlier than 1 hour before sunrise and end burning same day and no later than 1 hour before sunset.
  7. Weather conditions must be such that smoke will dissipate (winds of at least 6 mph - and no faster than 23 mph).
  8. The burn site must be physically supervised at all times during active burning.
  9. Burn supervisor must have immediate access to a telephone at all times should the burn get out of control and you require immediate Fire Department response.
